Last week, on December 20th, 2018, President Donald J. Trump signed the Agriculture Improvement Act, also known as the U.S. Farm Bill, that included a provision to allow for the cultivation of industrial hemp. Hemp was effectively made illegal by the Marihuana Tax Act of 1937, and after over 80 years, a brand new industry is being born.
Hemp has been making news for quite some time now. The 2014 Farm Bill expanded hemp research to determine economic opportunity and various ways hemp can be utilized. This year’s farm bill expanded hemp cultivation federally while also providing farmers with the ability to procure crop insurance, a major bonus when learning to cultivate a “new” crop. 2019 is going to see states incorporating their own set of hemp regulations, also provided for by the 2018 Farm Bill.
Clarification on CBD from the FDA were also announced immediately, stressing that CBD remains a controlled substance and bound to interstate commerce rules. The reason for this is that CBD is used in drug formulations. Expect this to be challenged this year. It can be argued that hemp and CBD have been used as food and for health and wellness long before the pharmaceutical industry tried to take control, and there are also other herbs that are used both in pharmaceutical formulations and as supplements.
